MOUD Discrimination and the ADA

Over the past few months MARR has received several inquiries about the issues surrounding the allowable use of MOUD (Medications for Opioid Use Disorder) in MARR certified recovery residences. Our parent organization, the National Alliance of Recovery Residences (NARR) tracks national developments in this arena. Recently, MARR reached out to NARR president, David Sheridan, for an updated understanding of where this issue sits within the national framework. He wrote, “I recently came across this item in Statnews about MOUD discrimination and the Americans With Disabilities Act. Also helpful is this (very recent) guidance from the Department of Justice on the same subject.”

Mr. Sheridan also wrote he was not aware of any case law specifically addressing recovery housing. This is an area we will continue to watch. In the meantime, the references in the links above provide useful background on the subject.
